PRIVACY POLICY
This Privacy Policy explains how Dancely ("we," "us," or "our") collects, uses, transmits, stores, shares, and deletes information when you use the Dancely mobile application and its AI-powered video creation services. Dancely is designed as a utility app, not a public social network or user-content community.
Dancely is intended only for users who are 17 years of age or older. We do not knowingly provide the Services to, or seek to collect personal information from, users under 17. If we become aware that personal information has been collected from a user under 17 without appropriate authorization, we will take reasonable steps to delete the information and, where appropriate, restrict or terminate access to Dancely.

Dancely does not provide public user profiles, a public content feed, user-to-user messaging, or a public user-content community. Content you upload for AI generation is not automatically made public to other Dancely users.
Depending on the features you actively use, Dancely may process the following categories of information:
User Content: photos, images, videos, reference materials, text prompts, generation instructions, and other materials you voluntarily select or upload for AI creation.
AI Generation Information: selected generation mode or template, prompts, generation parameters, task status, Generated Content, and generation failure or error information.
Device and Technical Information: depending on the technologies actually used by Dancely, device model, iOS version, app version, IP address, language and region settings, network information, crash data, diagnostic and performance information, and feature usage information.
Subscription and Purchase Information: product or subscription type, transaction identifier, subscription status, subscription start and expiration information, and App Store receipt-validation information. Apple processes App Store payments; Dancely does not directly receive your full credit card number or bank account information.
Dancely may request access to your camera or Photo Library when you actively choose to capture, select, upload, or save photos and videos. Camera access is used to capture source material for AI video creation. Photo Library access is used to select source material or save Generated Content. Granting permission does not cause Dancely to automatically upload all photos or videos stored on your device. Dancely processes only the content you actively select or provide.
Photos or videos voluntarily selected or uploaded by users may contain a person's face. Dancely treats these photos and videos as User Content and processes them only as source media for AI video generation, AI Dance, motion effects, animation, or other creative features actively requested by the user.
Dancely does not collect, extract, generate, use, or store Face Data from user-uploaded photos or videos. In particular, Dancely does not extract or maintain face mesh data, facial landmarks, facial coordinates, facial models, face embeddings, facial recognition templates, biometric identifiers, or other biometric facial profiles.
Dancely does not use uploaded photos or videos for facial recognition, biometric identification, authentication, or identity verification. Because Dancely does not collect or generate Face Data, Dancely does not store or share Face Data with third parties.
Where necessary to complete a user-requested AI generation, the original photo or video selected by the user may be transmitted as User Content to one or more third-party AI service providers identified in this Privacy Policy. This transfer concerns the user-provided media file itself and does not involve Dancely extracting or creating Face Data. The storage, retention, and deletion of such User Content are governed by the Third-Party AI Processing, Dancely Server Retention, Third-Party AI Retention, and Data Deletion Requests sections of this Privacy Policy.
To perform an AI video generation request initiated by you, Dancely may transmit only the User Content necessary to complete that request to one or more third-party AI service providers. Dancely currently uses or may use:
·xAI (Grok) — certain prompts, images, videos, or generation instructions may be transmitted where necessary for the selected feature.
·Kling AI — photos, videos, prompts, or generation instructions may be transmitted where necessary to generate or transform video content.
·Wan AI — photos, videos, prompts, or generation instructions may be transmitted where necessary for supported AI video or visual generation functions.
Depending on the feature you choose, your content may be sent to one or more of these providers.
Before Dancely sends relevant User Content to a third-party AI service, Dancely will disclose what data may be sent, which third-party AI provider(s) may receive it, and the purpose of the processing. Dancely will obtain your explicit consent before relevant User Content is sent for third-party AI generation. If you do not provide consent, Dancely will not send that User Content to the applicable third-party AI service for the generation request.
·Perform Image to Video generation.
·Perform Text to Video generation.
·Create AI Dance and motion effects.
·Apply AI video templates and other AI generation features.
·Deliver Generated Content.
·Validate subscriptions and purchases.
·Diagnose generation failures, crashes, and technical issues.
·Maintain service stability and security.
·Prevent fraud, abuse, and security threats.
·Comply with applicable legal obligations.
Dancely may temporarily store User Content on Dancely-controlled servers while processing your generation request. This may include uploaded photos, images, videos, text prompts, and generation instructions.
Dancely deletes user-uploaded photos, videos, and text prompts from Dancely-controlled servers within 24 hours after the generation request is completed.
Limited technical, transaction, fraud-prevention, security, dispute, or legally required records may be retained longer where reasonably necessary or required by law. Generated files may also be retained temporarily where needed to deliver or download the requested result, subject to the applicable retention rules disclosed by Dancely.
When User Content is transmitted to a third-party AI provider, that provider may process or temporarily retain it under its own API terms, technical configuration, enterprise agreement, and data-processing rules.
xAI (Grok): Under xAI's default API retention policy, API inputs and outputs may be retained for up to 30 days for security, abuse-prevention, and auditing purposes, unless Dancely uses Zero Data Retention or another separately agreed retention arrangement.
Kling AI: Retention is governed by the Kling AI API or enterprise terms applicable to Dancely's integration. Dancely does not state a fixed retention period unless confirmed by the applicable agreement or official service documentation.
Wan AI: Retention is governed by applicable Wan AI / Alibaba Cloud service terms and technical configuration. Certain generation task identifiers and generated-content URLs may expire after approximately 24 hours, but underlying retention practices may vary by model, endpoint, and service configuration.
Where a separate enterprise or data-processing agreement specifies a different retention period, that agreement controls.
You may ask Dancely to delete personal information or User Content associated with you by emailing dancelyprivacy@yahoo.com. Please provide enough information for Dancely to identify the relevant request or data. Dancely may request reasonable verification before completing a deletion request.
For information already transmitted to a third-party AI provider, Dancely will take reasonable steps to process deletion requests in accordance with the applicable provider agreement, available deletion mechanisms, and legal requirements. Certain information may be retained where necessary for legal compliance, transaction records, fraud prevention, security investigations, dispute resolution, or establishment or defense of legal claims.
You may withdraw consent to future third-party AI processing by contacting dancelyprivacy@yahoo.com. After withdrawal, Dancely will no longer rely on that consent to transmit new User Content to the applicable AI service. Withdrawal does not affect processing lawfully completed before consent was withdrawn. Because third-party AI processing is necessary for certain generation features, withdrawing consent may prevent those features from functioning.
Dancely does not use your uploaded private photos, videos, or text prompts to train a general-purpose Dancely AI model. Third-party AI providers process data under their applicable API, enterprise, and privacy terms. If Dancely's training practices materially change, this Privacy Policy will be updated and additional consent will be obtained where required by law.
Dancely does not automatically make your uploaded photos, videos, prompts, or Generated Content visible to other Dancely users. If you voluntarily share Generated Content through the iOS sharing interface to another app or service, the sharing is initiated by you and the receiving platform's privacy policy applies.
Dancely subscriptions are processed through the Apple App Store. Dancely currently offers Weekly Membership at $8.99 USD per week and Annual Membership at $54.99 USD per year. Payment is charged to your Apple Account upon confirmation of purchase.
Subscriptions automatically renew unless canceled before the end of the current subscription period. If you do not cancel, Apple will continue billing the applicable subscription price. You may manage or cancel the subscription through your Apple Account subscription settings. After cancellation, your subscription remains active until the end of the current paid period and will not renew for the next billing period. Deleting Dancely does not cancel an Apple subscription. Refunds and payment disputes are handled by Apple under applicable App Store policies.
Dancely uses reasonable technical and organizational safeguards designed to protect information against unauthorized access, misuse, loss, alteration, or disclosure. Depending on the systems involved, safeguards may include encrypted transmission, access controls, restricted server permissions, data minimization, and security monitoring. No Internet transmission or electronic storage system can be guaranteed to be completely secure.
Dancely and its third-party service providers may process information in countries or regions other than the country where you live. Where required by applicable law, appropriate safeguards are used for international transfers of personal data.
Depending on your location, you may have rights to request access, correction, deletion, restriction, objection, withdrawal of consent, or a copy of certain personal information, and to submit a complaint to a competent data-protection authority. Dancely does not sell User Content such as uploaded photos, videos, or text prompts. If Dancely later introduces technology that constitutes "Tracking" under Apple's App Tracking Transparency requirements, Dancely will request permission where required and update this Privacy Policy accordingly.
Dancely may update this Privacy Policy when product features, AI providers, data practices, or legal obligations change. Where required by law, Dancely will provide reasonable notice of material changes.
